Privacy Policy

Introduction

CARRIER1 Corporation, an Arizona corporation (together with its subsidiaries and affiliates, individually or collectively as the context requires, "CARRIER1" or "we"), respects your privacy and we are committed to protecting it through our mutual compliance with this policy. This Privacy Policy (this "Policy") describes the general types of information we may collect from you or that you may provide when you visit the website https://carrier1.com and any related subdomains (the "Website"), when you access the CARRIER1 platform at app.carrier1.com, and when you use any CARRIER1 mobile application, together with the CARRIER1 platform, the "Services," and together with the Website, the "Platform", and CARRIER1's practices for collecting, using, maintaining, protecting, and disclosing that information.

This Policy applies to information we collect:

  • On or through the Platform.
  • In email, text, and other electronic messages with or through the Platform.
  • When you interact with CARRIER1 advertising and applications on third-party websites and services, if those applications or advertising include links to this Policy.

This Policy does not apply to information collected by:

  • CARRIER1 offline or through any other means, including on any other website operated by CARRIER1 or any third party; or
  • Any third party, including through any application or content (including advertising) that may link to or be accessible from or on the Platform.

Please read this Policy carefully to understand CARRIER1's policies and practices regarding your information and how we will treat it. If you do not agree with this Policy, your choice is not to use the Platform. By accessing or using the Platform, you agree to be bound by the terms of this Policy. This Policy may change from time to time (see "Changes to CARRIER1 Privacy Policy" below). Your continued use of the Platform after we make changes is deemed to be acceptance of those changes, so please check the Policy periodically for updates.

Our Role: Controller and Service Provider

CARRIER1 acts in two different capacities depending on the information involved, and your rights differ accordingly.

Where CARRIER1 determines the purposes and means of processing — for example, information collected through the Website, marketing and sales inquiries, and CARRIER1's own account, billing, and support records — CARRIER1 acts as a controller, and this Policy governs that information.

Where CARRIER1 processes information on behalf of a business that licenses the Services (a "Customer") — including information about that Customer's drivers, dispatchers, and other personnel, information about the Customer's tenants, vendors, and business contacts, and the Customer's freight, load, document, location, and settlement records — CARRIER1 acts as a service provider or processor. CARRIER1 processes that information only as directed by the Customer and as permitted by the applicable Order Form and the CARRIER1 Platform Terms and Conditions, and not for CARRIER1's own independent commercial purposes. In that case, the Customer, not CARRIER1, determines what information is collected and how it is used, and the Customer's own privacy policy governs.

If you are a driver, dispatcher, or other individual whose information was entered into the Services by a Customer and you wish to access, correct, or delete that information, please contact that Customer directly. If you contact CARRIER1 instead, we will refer your request to the applicable Customer and will assist that Customer in responding to the extent required by our agreement with them and by applicable law.

Children Under the Age of 18

The Platform is not intended for children under 18 years of age. No one under age 18 may provide any information to or on the Platform. We do not knowingly collect personal information from children under age 18. If you are under age 18, do not use or provide any information on the Platform or on or through any of its features. If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information. Geographic Access Restrictions

The Platform is not intended for use by users located in the European Union ("EU") or any member state of the EU. No user located in the EU may provide any information to or on the Platform. We do not knowingly collect personal information from users located in the EU. If you are located in the EU, do not use or provide any information on the Platform or on or through any of its features. If we learn we have collected or received personal information from a user located in the EU, we will delete that information. Information We Collect About You and How We Collect It

We collect several types of information from and about users of the Platform, including:

  • Personal information such as name, postal address, email address, telephone number (including mobile telephone number), credit card information, or any other identifier by which you may be contacted online or offline;
  • Non-identifying information such as zip code or device identifiers; and
  • Technical data such as your internet connection, browser type, operating system, and Platform usage details; and
  • Operational data generated through use of the Services, such as load assignments, load status and exception events, timestamps, documents and images you capture (including proof of delivery and bills of lading), messages sent through the Services, and location information as described below.

We collect this information:

  • Directly from you when you provide it to us.
  • Automatically as you navigate the Platform (including through cookies).
  • From third-party business partners.
  • From a Customer that has licensed the Services, where that Customer enters or uploads information about you, such as your name, role, and mobile telephone number.

Information You Provide to CARRIER1

The information you provide on or through the Platform may include:

  • Form submissions, such as registration, order placement, service subscriptions, and support inquiries;
  • Correspondence records, including email addresses;
  • Survey responses;
  • Transaction details, including payment and order history;
  • Search queries;
  • User Contributions to public areas of the Platform.

User Contributions are made at your own risk and may be accessed by unauthorized parties despite efforts to secure them.

Payment card information submitted in connection with the Services is processed by third-party payment processors. CARRIER1 does not store full payment card numbers.

Automatic Data Collection Technologies

We may use cookies, flash cookies, and other tracking technologies to automatically collect:

  • Traffic and location data;
  • Device characteristics and identifiers;
  • Platform usage patterns.

You may manage your cookie preferences via your browser settings. Some Platform features may not function properly if cookies are disabled.

Third-Party Use of Cookies

On the Website, third parties such as advertisers or content providers may use cookies to collect information about you. These parties may use such data to deliver targeted advertising. CARRIER1 does not control third-party tracking technologies. For opt-out options, see "Choices About How We Use and Disclose Your Information" below. CARRIER1 does not permit third-party advertising or cross-context behavioral advertising technologies within the Services or the CARRIER1 mobile applications.

Location Information from Mobile Applications

CARRIER1's mobile applications, including DRIIVE, may collect location information from a mobile device in order to provide load status, arrival and departure events, estimated times of arrival, and proof of pickup and delivery to the Customer that assigned the load. Where an application collects precise geolocation, it does so only with the permission you grant through your device operating system, and you may withdraw that permission at any time through device settings. Withdrawing location permission may prevent certain features of the Services from functioning.

Location information collected through the Services is processed on behalf of the Customer that employs or engages you. That Customer determines whether location collection is enabled, when it occurs, and how the resulting information is used. Questions about a Customer's use of location information should be directed to that Customer.

Text Messaging (SMS/MMS)

CARRIER1 collects mobile telephone numbers in order to deliver operational text messages relating to load assignments, load status and exceptions, dispatch communication, arrival and delivery notifications, document requests, and invoice and settlement notifications. CARRIER1 does not send marketing or promotional text messages. Message frequency varies with account activity. Message and data rates may apply.

Consent to receive operational text messages is obtained by the CARRIER1 Customer that employs or engages the recipient, as part of the recipient's onboarding. The first message sent to a recipient identifies CARRIER1, and recipients may opt out at any time by replying STOP to any message, and you may reply HELP or contact Support@carrier1.com for assistance. Operational messages are sent only in connection with the recipient's own load, dispatch, and account activity.

CARRIER1 does not share, sell, rent, or otherwise provide mobile telephone numbers or text messaging consent data to any third party or affiliate for marketing or promotional purposes. CARRIER1 discloses this information only to subprocessors and messaging service providers acting on CARRIER1's behalf to deliver messages, and as required by law.

How We Use Your Information

We use your information to:

  • Operate and present the Platform;
  • Provide requested services and customer support;
  • Manage your account and deliver transactional communications;
  • Notify you of changes to the Platform or our services;
  • Enforce contracts;
  • Facilitate interactive features; and
  • For any purpose disclosed at the time of collection or with your consent.

Disclosure of Your Information

We may disclose non-identifiable, aggregated user information without restriction. We may disclose personal information:

  • To our subsidiaries and affiliates;
  • To contractors and service providers;
  • In connection with corporate transactions (e.g., mergers or asset sales);
  • To comply with legal obligations;
  • To enforce agreements and protect rights or safety.
  • To a Customer, where CARRIER1 processes your information on that Customer's behalf as described under "Our Role: Controller and Service Provider" above.

Mobile telephone numbers and text messaging consent data are excluded from the sharing described in this section. CARRIER1 does not share, sell, or rent that information to any third party or affiliate for marketing or promotional purposes.

CARRIER1 does not sell personal information, and does not share personal information for cross-context behavioral advertising, as those terms are defined under the California Consumer Privacy Act and comparable state privacy laws. Where CARRIER1 uses analytics or advertising technologies on the Website, CARRIER1 honors opt-out preference signals, including the Global Privacy Control, transmitted by your browser.

Choices About How We Use and Disclose Your Information

You can:

  • Adjust browser settings to manage cookie tracking.
  • Opt out of promotional emails by contacting Support@carrier1.com or using unsubscribe links in emails.
  • Opt out of operational text messages by replying STOP to any message.
  • Withdraw location permission through your mobile device settings.
  • Visit the NAI website to opt out of interest-based ads from NAI members.
  • Nevada residents may submit opt-out requests to Support@carrier1.com, though we do not currently sell personal data under Nevada law.

Your State Privacy Rights

Depending on where you live, you may have some or all of the following rights with respect to personal information for which CARRIER1 acts as a controller: to confirm whether we process your personal information and to access it; to correct inaccurate personal information; to delete personal information; to obtain a portable copy of personal information you provided to us; to opt out of the sale of personal information, targeted advertising, and profiling in furtherance of decisions producing legal or similarly significant effects; and to limit the use of sensitive personal information. We will not discriminate against you for exercising any of these rights.

To submit a request, email Support@carrier1.com with the subject line "Privacy Request." We will verify your identity before responding, which may require you to provide additional information. An authorized agent may submit a request on your behalf with proof of authorization. We will respond within the time period required by applicable law, generally forty-five (45) days, and may extend that period where permitted.

If we decline your request, you may appeal by emailing Support@carrier1.com with the subject line "Privacy Appeal." We will respond to an appeal within the period required by applicable law and, if the appeal is denied, will provide information about how to contact your state attorney general.

Where CARRIER1 processes your personal information on behalf of a Customer as a service provider or processor, please direct your request to that Customer, as described under "Our Role: Controller and Service Provider" above.

Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Policy, to comply with our legal obligations, to resolve disputes, and to enforce our agreements. Information that CARRIER1 processes on behalf of a Customer is retained for the term of that Customer's agreement; following termination or expiration, the Customer may request an export of its data within thirty (30) days, after which CARRIER1 may delete it. Text messaging opt-out status is maintained by CARRIER1's messaging service provider and is honored for as long as it remains in effect. Records relating to message delivery are retained in accordance with CARRIER1's data retention practices.

Data Security

CARRIER1 maintains administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction. Further information about CARRIER1's security practices is available at https://carrier1.com/security. No method of transmission or storage is completely secure, and CARRIER1 cannot guarantee the security of information transmitted to or through the Platform.

Changes to CARRIER1 Privacy Policy

We will post any changes to this Policy on this page. Material changes will be announced via a notice on the Platform homepage. You are responsible for ensuring we have a current, valid email address for you, and for checking the Platform periodically for updates. The Effective Date at the top of this Policy indicates when it was last revised.
